Hampton Roads For Rent By Owner, LLC (HRFRBO) provides advertising services for Homeowners, Property Managers and Investors with rental properties.  HRFRBO is not a Real Estate Agency and do not provide nor attempt to provide real estate services nor property management whatsoever.  HRFRBO services are strictly for advertising rental properties for Homeowners, Property Managers and Investors.  This Agreement (Terms and Conditions) sets forth the terms and conditions that apply to your access and use ("User") of www.hrforrentbyowner.com ("Website") and Hampton Roads For Rent By Owner Magazine (“Publication”).  Your use of the Website and/or Publication advertising shall constitute your acceptance of these terms and conditions.  HRFRBO reserves the right to change the terms and conditions of this agreement as we deem appropriate.  Such changes, modifications, additions or deletions shall be effective immediately upon posting unless otherwise indicated.  HRFRBO, its officers, agents, directors and employees have no duty or obligation to inform prior Users of our Website and Publication that changes have been made, regardless of the type of change.  HRFRBO advise the User to review this Agreement periodically so that you will always be informed of any changes to the terms and conditions that apply to your access and use of the Website and Publication.

The Website and Publication provide Homeowners, Property Managers and Investors the ability to advertise their properties for rent.  Due care and diligence is used in checking advertisements for accuracy, but no warranty is given.  HRFRBO, its officers, directors, agents and employees shall not be responsible nor liable for misinformation, misprints, negligence, delayed advertisements and/or typographical errors herein contained.  The content of this Website and Publication and its advertisement are published "as is".  HRFRBO, its officers, directors, agents and employees make no warranty nor guarantee that advertising on our Website or in our Publication will fill your rental property.  In no event nor circumstance shall HRFRBO, its officers, agents, directors and employees be liable for lost of profit or any special, incidental or consequential damages, including negligence arising out of or in connection with this agreement.

Disclaimer to the Homeowner, Property Manager and Investor

By using HRFRBO, the Website and Publication you agree that:

Your advertisement content is complete, accurate and true;
You are of legal age and are capable of forming a legally binding contract;
You are interested in renting out your property;

 
As the Homeowner, Property Manager or Investor you are not to misrepresent your property.  HRFRBO, its officers, directors, agents and employees take no responsibility for any misrepresentations that you have made using our advertising services.  We encourage the Homeowner, Property Manager and Investor to investigate its Renters, as it assumes no responsibilities for the qualification of the Renters that are obtained from advertising on this Website and Publication.
 
Due to the volume of information and materials submitted, you agree that HRFRBO, its officers, directors, agents and employees reserve the right to review, reject, delete, remove, modify or edit any information and materials at any time for any reason, without liability and without notice to you.
 
You hereby represent and warrant that:  you have all necessary authority, rights and permissions to submit the information and materials.  The information and materials are accurate, current and complete.  The information and materials and your use of the Website and Publication shall not infringe or misappropriate any copywright, trademark or property right of any third party or violate any other rights of third party, including, without limitation, any rights of privacy or publicity.   The information and materials and your use of the Website and Publication shall not violate any applicable law or regulation, including, without limitation, any applicable advertising or fair housing laws regulations.  The information and materials shall not cause harm nor injury to any person.

Our Website and Publication is used to provide advertisement to potential Renters.  HRFRBO, its officers, directors, agents and employees do not warranty in any way the properties advertised on our Website and Publication.  It is the Renter’s responsibility to investigate the information obtained on our Website and Publication.  HRFRBO, its officers, directors, agents and employees hereby expressly warns all potential Renters to verify all property information and transaction details for themselves.  HRFRBO, its officers, directors, agents and employees do not perform any verification of advertising content as to accuracy or completeness.  The advertisements have been created from information submitted from the Homeowner, Property Manager or Investor.

Privacy Policy

Your privacy is very important to us and we are committed to protecting your privacy when using our Website.  However, we can not warrant the security of any information you transmit online to us is 100% secure, therefore, you do so at your own risk.  Once we receive your information we will make our best effort to ensure your privacy is secure in our system.  Please be advised you shall be responsible for protecting the confidentiality of your password.  Your account information is password protected, therefore, we recommend you do not give your password to anyone.  We will never ask you for your password in a phone call or in an email.  Also remember to sign out of your account and close your browser window when you have finished your visit to our Website.  We do not sell or rent your personal information to third parties.   We will not disclose your personal information except when we have your permission or under special circumstances when the law requires it or we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our Terms and Condition.

Use of Third Party Services

You understand and agree that HRFRBO, its officers, agents, directors and employees are not responsible nor liable for any acts or omissions created or performed by third parties.  Such third parties advertisements are provided for your information only.  HRFRBO, its officers, agents, directors and employees do not verify the completeness nor accuracy of the content of third party services advertised in the Publication.  All such references to third party services is the Users responsibility to evaluate the accuracy and completeness themselves.
 

Billing, Cancellation and No Refund Policy

 
You hereby agree that, upon your registration to our Website you shall be subject to certain charges based on the selected plan.  You hereby authorize HRFRBO to charge your credit or debit card to pay for the selected plan at the current rate and authorize HRFRBO, its officers, directors, agents and employees to process such transactions on your behalf.
 
HRFRBO may, at any time and at its sole discretion, cancel any Trial Plan, Bi-Weekly or Monthly Plan.  If HRFRBO cancels any Plans prior to its expiration due to the Homeowner's, Property Manager's or Investor's misrepresentation and/or negligence, HRFRBO shall not provide a refund.  All cancellations received by HRFRBO will be effective immediately.
 
The purchase of this service is non-refundable.  All services charges are billed as final.  You hereby acknowledge and agree that if you cancel during or after the then bi-weekly or monthly plan you shall not be entitled to any pro-rated or partial refund of the current plan.  HRFRBO does not offer refunds for unused advertising time.
 

 
Payment Methods

HRFRBO accepts major credit or debit cards including Visa, Mastercard, American Express, personal checks, money orders and cashier checks.  HRFRBO may charge a $25.00 fee for each check returned unpaid for insufficient funds or any other reason.

 
Termination

HRFRBO reserves the right, at it's sole discretion, to block either access to our site or the use of the site by any specific user.  HRFRBO may terminate this agreement without liability at any time without notice for any reason.
